The Tyrolean Children’s and Youth Ombudsperson

In November 1994, the Tyrolean provincial parliament decided to appoint a Tyrolean Children’s and Youth Ombudsperson. The provincial gouvernment appointed Mag. Franz PREISHUBER as the Children’s and Youth Ombudsperson for a period of five years beginning 01. June 1995.

The Children’s and Youth Ombudsperson has his office in Innsbruck but also has consultation days outside the provincial capital. The services of the Children’s and Youth Ombudsperson are free of charge, confidential and anonymous.

Responsibilities: (Re: § 6a of the Tyrolean Youth Welfare Act)

Within the area of youth welfare the Children’s and Youth Ombudsperson ist to:

a) advise minors, those with parental authority and legal representatives in all matters relating to the position of minors and the responsibilities of those with parental authority,

b) help in cases of differences of opinion and disagreements between those with parental authority and minors concerning their care and upbringing,

c) negotiate in cases of differences of opinion and disagreements between those with parental authority and minors on the one hand, and between authorities designated with the implementation of this welfare act and institutions from independent youth welfare on the other.

Further responsibilities of the Children’s and Youth Ombudsperson are:

a) under consideration of similar activities by other institutions in the province, to promote improvements in the living condition for children and young persons and to point out any abuses relating to these.

b) to participate in the assessment of the drafts of provincial acts and laws relating to the interests of children and young persons and to represent these interests.

c) to submit an annual progress report to the provincial government which is to be passed on to the provincial parliament.

The Children’s and Youth Ombudsperson is not subject to any directives (provincial constitutional regulations) in the carrying out of any duties.
